Disputes
This contract is governed by French law. Euro Souvenir Portugal S.A.S. cannot be held liable for damages of any kind, whether material, immaterial or physical, that may result from improper operation or misuse of the products sold. The same applies to any changes to products made by manufacturers. The liability of Euro Souvenir Portugal S.A.S. shall, under all circumstances, be limited to the amount of the order and may not be incurred for simple errors or omissions that may have remained despite all precautions taken in the presentation of the products. In the event of difficulties in the application of this contract, the buyer has the option, before taking legal action, of seeking an amicable solution with the help of: a professional association in the sector, a consumer association or any other advisor of their choice. It should be noted that seeking an amicable solution does not interrupt the statutory guarantee period or the duration of the contractual guarantee. It is recalled that, as a general rule and subject to the courts' assessment, compliance with the provisions of this contract relating to the contractual guarantee presupposes that the buyer fulfils their financial obligations to the seller.
Complaints or disputes will always be received with attentive goodwill, good faith being always presumed in those who take the trouble to state their situation. In the event of a dispute, the customer shall address the company as a priority to seek an amicable resolution.
Warranty
In all cases, Euro Souvenir Portugal S.A.S. cannot be held liable for non-compliance with the regulatory and legislative provisions in force in the country of receipt. The liability of Euro Souvenir Portugal S.A.S. is systematically limited to the value of the product in question at its date of sale, with no possibility of recourse against the brand or the company producing the product.
In any event, the customer benefits from the statutory guarantee against eviction and hidden defects (Art.1625 et seq. of the Civil Code). Provided the buyer proves the hidden defect, the seller is legally required to remedy all consequences thereof (art.1641 et seq. of the civil code); if the buyer takes the matter to court, they must do so within a "brief period" from the discovery of the hidden defect (art.1648 of the civil code).
